1. In plain English (summary)

This is a short, plain-English summary of what you are agreeing to. The full terms below are what legally apply — if anything here differs from them, the full terms prevail. Please read them.

We compare what card payments really cost you across Australian providers, using the numbers you give us or read from a statement you upload.

We are not a broker or a financial adviser. We give you factual comparison information, not advice on financial products; the decision is yours, and nobody calls you.

Our figures are estimates. Always confirm the actual price and terms with the provider before you switch.

We rank on what card transactions cost you. Not on terminals or POS hardware — we show those separately. We may earn a referral fee, and some providers offer a better rate through us; neither affects nor buys a higher ranking.

If you go ahead, your contract is with the provider, not with us — and from that point their terms and privacy policy apply.

Your legal rights are protected. Nothing here removes the consumer guarantees you have under Australian law.

2. About these terms

These Terms of Use govern your access to and use of compayr.com.au (the "site"), operated by Compayr, a registered business name of Neural Pathways Pty Ltd, ABN 99 684 738 289 ("Compayr", "we", "us", "our"). By accessing or using the site, you agree to these terms. If you do not agree, please do not use the site.

Our Privacy Policy (compayr.com.au/privacy) and our Statement Upload Consent & Privacy Notice (compayr.com.au/statement-upload-notice) also apply and form part of these terms. If there is any inconsistency, those documents prevail over these terms in respect of the handling of personal information.

3. What Compayr is — and is not

Compayr is a self-serve comparison tool that helps Australian businesses compare the cost of card payment acceptance across providers. We are not a payment provider, a bank, a broker acting on your behalf, or a financial adviser. We provide factual comparison information to help you make your own decision. We do not arrange, recommend or sell any product.

Compayr is not owned or controlled by any payment provider, it holds no interest in any provider it compares, and no provider holds an interest in Compayr. We receive a referral fee from some providers we compare — section 6 explains how, and why we do not consider it to affect our rankings.

4. Our comparisons are estimates — verify with the provider

Comparisons and costs shown are indicative estimates only, generated from providers' published pricing and the figures you enter. Rates, fees and provider terms change, and a provider may offer you different pricing. We take care to keep information current (each rate shows the date it was last verified), but we do not warrant that it is accurate, complete or up to date. Always confirm the actual price and terms directly with the provider before you make a decision.

What we compare

We rank providers on the cost of card acceptance: the transaction pricing and recurring account fees you pay to accept card payments. We do not rank on equipment. Terminals, POS hardware, software and terminal rental are excluded from the ranked figure and are displayed separately, as are chargeback, PCI compliance, refund and instant-payout fees. A provider ranked cheapest is cheapest on the cost of card acceptance and may not be cheapest once equipment and other charges are included. Currency and GST

All figures are in Australian dollars and are shown GST-inclusive by default — the way providers quote — with an ex-GST toggle for your accounting figures. Every figure is labelled with its GST basis. GST treatment differs by fee type: merchant service fees for card processing are generally treated as input-taxed financial supplies and do not attract GST, while hardware, terminal rental, software and other add-on services generally do. Where a provider quotes on a different basis, our figures follow that provider's published basis. Compare like for like, and confirm the GST position of any quote with the provider or your accountant — we are not tax advisers.

5. Not financial or other professional advice

The information on the site is general and factual only. It does not take into account your objectives, financial situation or needs, and it is not financial product advice, nor legal, tax or accounting advice. You should consider whether the information is appropriate for your circumstances and obtain your own professional advice before acting on it. We are not required to hold an Australian Financial Services Licence for the service described in these terms. We do not deal in, issue, or arrange for you to acquire, any financial product, and nothing on the site is a recommendation, or an inducement, to acquire, dispose of, or vary any financial product.

6. Our ownership and how we are paid

Section 3 is about who owns or controls Compayr, not about commercial relationships we have. We receive money from some providers. This is how: our rankings are ordered on the lowest cost of card acceptance to you, as defined in section 4. Compayr may receive a referral fee from a provider when a merchant switches through us; this does not affect our rankings, and we do not accept payment for ranking position or placement. Every provider is ranked on the same published rates and the same formula. No provider can pay for position.

We include providers with which we have no referral arrangement. A provider's inclusion in, or position within, the comparison does not depend on any commercial relationship with us, and the amount we may receive varies between providers. We disclose our commercial relationships on the comparison results themselves, with our published methodology at compayr.com.au/how-we-compare as the linked detail; this section is not the primary place we make that disclosure.

How the handover works

When you choose a provider, we send you to that provider's own signup with a referral code identifying Compayr (not you) so the provider knows the introduction came from us. Any application or contract is then between you and the provider.

What we may earn

Our fee may be a one-off amount when a referred merchant activates, an ongoing share while they process, or both, and the amount can vary by provider and by whether you complete the signup. We do not seek or receive any payment relating to a provider's position or prominence in our rankings.

Exclusive rates

Some providers offer an exclusive rate to merchants who come through Compayr. Where they do, we show and clearly label that rate (and any conditions that apply), and we rank on the rate you will actually receive. A preferential rate lowers your cost — it is a benefit to you, not a payment to us for ranking position. Exclusive rates are not offered on providers whose merchant onboarding creates a settlement or transaction account. For those providers we show the standard published rate only.

Where a provider offers Compayr a choice between a higher referral fee and a preferential rate for merchants referred by us, we target the preferential rate. Exclusive rates are only available from providers with which we have a commercial arrangement; this does not affect the basis on which we rank, which is the cost of card acceptance (as defined in section 4) you would actually pay.

7. Dealing with providers

If you choose to proceed to a provider, any application, contract, product or service is solely between you and that provider, on their terms. Compayr is not a party to it and is not responsible for a provider's products, pricing, decisions, conduct, or any change a provider makes to its pricing or terms. Any issue with a provider's product or service is a matter between you and that provider.

The handover boundary

Where you ask us to connect you, we provide only the information needed to your chosen provider — from which point your personal information becomes subject to that provider's privacy policy, and their handling of it is their responsibility.

8. Acceptable use

You agree to provide accurate information and to use the site only for lawful purposes and for your own business assessment. You must not:

Scrape, crawl, harvest or otherwise systematically extract data, rates or content from the site without our prior written permission.

Use bots, scripts or other automated tools to interact with our outbound referral links, comparison tools or upload forms, or otherwise generate clicks or signups that do not reflect a genuine merchant enquiry.

Attempt to gain unauthorised access to any part of the site, its data or its underlying systems.

Use the site in any way that could damage, disable, overburden or impair its operation.

Upload any statement or document you are not authorised to provide, or fail to redact sensitive information as asked.

Use the site for any unlawful purpose, or to misrepresent your identity or your business.

9. Statement uploads

If you upload a statement, you permit us to use it to provide your comparison or review as described in our Privacy Policy and the Statement Upload Consent & Privacy Notice, and you confirm you are authorised to provide it.

10. Intellectual property

The site, its content, design, data compilations and branding are owned by or licensed to Compayr and protected by law. We grant you a limited, revocable, non-exclusive licence to access and use the site for your own business assessment. You must not reproduce, republish, resell, or systematically extract our content or data without our written permission.

Provider names, logos and trade marks shown on the site are the property of their respective owners and are used here for identification and comparison purposes only. Their use does not imply any affiliation with, sponsorship by, or endorsement from those providers.

11. Third-party links and content

The site may link to provider and other third-party websites. We do not control and are not responsible for their content, products or practices, and a link is not an endorsement. Your use of any third-party site is at your own risk and is subject to that site's own terms and privacy policy.

12. Availability

We provide the site on an "as is" and "as available" basis. We may change, suspend or withdraw the site or any feature, and we do not guarantee that it will be uninterrupted, secure or error-free. A change under this section applies to your use of the site going forward and does not retrospectively alter a comparison already shown to you.

13. Consumer guarantees, warranties and limitation of liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to the paragraph above, and to the maximum extent permitted by law, we exclude all warranties, conditions and representations relating to the site and its content, whether express or implied, including as to accuracy, completeness, currency, fitness for purpose and availability.

Subject to the first paragraph of this section, and to the maximum extent permitted by law: we are not liable for any indirect or consequential loss, or for loss arising from your reliance on estimates or from your dealings with a provider, for loss arising from an inaccuracy in information published by a provider, or for loss arising from an interruption to a provider's or another third party's systems that is beyond our reasonable control; and our total liability to you in connection with the site is limited, at our election, to re-supplying the relevant information or to $100.

14. Indemnity

To the extent permitted by law, you agree to indemnify us against any loss we suffer arising from a third-party claim caused by your breach of these terms, your misuse of the site, or your provision of a statement or information you were not authorised to provide. This indemnity does not apply to the extent the loss was caused or contributed to by us, and is reduced proportionately to reflect our own contribution to the loss. Notwithstanding and without limitation to the other limitations of liability, our proportional liability in connection with the site is capped at $10,000.

15. Privacy

Our Privacy Policy at compayr.com.au/privacy explains how we handle personal information and forms part of these terms.

16. General

These terms, together with our Privacy Policy and our Statement Upload Consent & Privacy Notice, are the entire agreement between you and us about your use of the site, and replace any prior representations about it, except a representation that cannot lawfully be excluded. If any provision of these terms is found to be unenforceable, it is severed and the remaining provisions continue to apply. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these terms without our consent; we may assign ours in connection with a sale or restructure of the business.

17. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.

18. Changes to these terms

We may update these terms from time to time. Where a change is material, we will give at least 14 days' notice on the site before it takes effect. The current version is always at compayr.com.au/terms, with the effective date shown at the top. A change applies to your use of the site from its effective date and is not retrospective.
